By using ExpressWithACard (operated by Digital Cards Ltd, Company No. 1616503, trading as ExpressWithACard, "we", "us", "our"), you agree to the following Terms. If you do not agree, you must not use our Services. Users must be 18 or over, or acting under adult supervision on a parent's or guardian's account.

Your use of our Services is also subject to our Privacy Policy available at expresswithacard.com.

1. Services and Digital Delivery

We provide digital group greeting cards ("Cards"). Upon successful payment, your unique Card link is delivered instantly on-screen and via email. Delivery to the Recipient occurs only when you choose to send it.

Access: Cards are accessible for a minimum of 12 months from creation.

Deletion: You may delete a Card at any time. We retain a soft-delete record (metadata and transactions) strictly for legal, audit, and UK GDPR compliance purposes. This data is not accessible to users following deletion.

2. Payments and Pricing

All payments are securely processed by Stripe, Inc. We do not store your payment details. If you purchase a Card bundle, a credit is deducted upon Card creation and refunded if the Card is deleted before being sent. Bundle credit expiry is displayed on your bundle and our pricing page.

3. Collection Pots and Gift Cards

Card creators may optionally enable a Collection Pot to gather monetary contributions for a group gift.

3.1 Contributions and Fees

We do not charge a platform fee on contributions. A non-refundable Stripe processing fee is added at checkout and is clearly shown before payment is confirmed. The total collected face value is converted into a Gift Card without further deductions. The currency of the Pot is locked upon creation and determines the region of redemption (for example, a GBP pot generates a Gift Card redeemable only with UK partners).

3.2 Gift Card Fulfilment

When the Card is sent, collected funds automatically generate a digital Gift Card delivered to the Recipient. We do not issue or manage Gift Cards directly. From the point of generation, redemption is subject exclusively to our Gift Card provider's (Prezzee, www.prezzee.uk) Terms of Service and Terms of Sale.

  • Availability and Expiry: Our gift card provider and its partnered retailers manage brand selection, denominations, and expiry dates. We cannot guarantee brand availability and accept no liability for these external policies.
  • No Cash Value: Gift Cards cannot be exchanged for cash.

3.3 Cancellations and Refunds on Contributions

Contributions are pooled and converted into a Gift Card when the Card is sent. Individual contributions can only be refunded before that conversion takes place. If you wish to withdraw your contribution before the Card is sent, contact [email protected]. Once the Card is sent and the Gift Card is generated, no refunds or cancellations are possible.

4. Consumer Rights and Refunds

In addition to your statutory rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013, we offer a 30-Day Refund Policy: you may receive a full refund on any Card purchase within 30 days, provided the Card has not yet been sent to a Recipient.

Refunds are processed to your original payment method within 14 days of receiving your valid request. To request a refund or report faulty digital content, contact [email protected].

5. User-Generated Content and AI Features

5.1 General Content

You warrant that any messages, images, videos, or GIFs you upload do not infringe third-party intellectual property or privacy rights, and do not contain unlawful, offensive, or harmful material. We do not claim ownership of your content but require a licence to host and deliver it to provide the Service.

5.2 AI Image generation tool

Our optional AI Image generation tool processes photographs of faces for a creative image effect only, not for identification purposes. As a precaution, we handle these images with the additional care appropriate to sensitive personal data and require your explicit consent before use.

  • Consent: You must give explicit consent before using this feature, via a clear in-context notice at the point of upload. You confirm that you have the written consent, release, and/or permission of each and every identifiable individual whose likeness appears in any image you upload, to use their name or likeness in the manner contemplated by this feature.
  • Processing: Source photos are processed in your browser's local cache and are not stored on our servers. The AI-generated output image is stored as part of the Card.
  • Restrictions: You must not upload images of persons under 18, create defamatory or harmful content, or generate deepfakes intended to deceive or harm.

6. Prohibited Uses

You may not use our Services for fraudulent activity, unauthorised data scraping, distributing malware, infringing third-party rights, or any actions that violate the laws of England and Wales. Breaches will result in immediate termination of access.

7. Limitation of Liability and Governing Law

We never exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation, or any other liability that cannot lawfully be excluded.

Subject to the above, and to the maximum extent permitted by law, Digital Cards Ltd is not liable for indirect, consequential, or special losses, including data loss or third-party redemption issues. Our total liability is limited to the amount paid for the specific transaction giving rise to the claim.

These Terms are governed by the laws of England and Wales. Disputes are subject to the exclusive jurisdiction of the English and Welsh courts, without prejudice to the rights of consumers in Scotland, Northern Ireland, or abroad to bring proceedings in their local courts or to rely on mandatory local consumer protections.

8. Complaints and Alternative Dispute Resolution

If you have a complaint, please contact us first at [email protected] and we will do our best to resolve it promptly. If we are unable to resolve your complaint, you may refer it to an alternative dispute resolution scheme. Information about approved ADR providers is available at https://www.gov.uk/government/collections/alternative-dispute-resolution-for-consumers. Use of ADR is voluntary and does not affect your right to bring legal proceedings.

9. General

If any provision of these Terms is found to be unenforceable, the remaining provisions continue in full force. No third party has any right to enforce these Terms under the Contracts (Rights of Third Parties) Act 1999. If we fail to enforce any right under these Terms, this does not waive our right to do so at a later date. Nothing in these Terms affects your statutory rights as a consumer.
